These terms apply to customers purchasing services or individuals whom we may contact while providing these services. By engaging with our website or services, you agree to these Terms.

  1. Definitions
  • Customer: Any individual or entity purchasing lead generation or appointment setting services from Foculus Marketing.
  • Contact/Lead: Any individual or business whom Foculus Marketing may contact on behalf of a Customer for the purpose of lead generation or appointment setting.
  • Services: All lead generation and appointment setting activities performed by Foculus Marketing.
  1. Scope of Services
  • Foculus Marketing provides lead generation services to identify and qualify potential customers for our clients, and appointment setting services to schedule meetings between those leads and our clients.
  • The specifics of service delivery, including the number of leads, criteria for qualified leads, and appointment confirmation processes, will be detailed in a separate agreement with each Customer.
  1. Consent and Compliance

For Contacts/Leads:

  • Foculus Marketing will only contact individuals or businesses where we have obtained prior express written consent, in compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and other applicable laws.
  • All outreach communications will include clear opt-out instructions, and we will honor all opt-out or do-not-contact requests promptly.
  • We do not use robocalls, prerecorded messages, or AI-generated calls for initial outreach unless we have the required consent.

For Customers:

  • Customers must ensure that any data provided to Foculus Marketing for outreach purposes has been lawfully obtained and that they have the right to use such data for marketing and appointment setting.
  • Customers are responsible for complying with all applicable data privacy and telemarketing laws in their jurisdiction.
  1. Data Collection and Use
  • Foculus Marketing collects and processes personal information such as names, email addresses, phone numbers, and business details for the sole purpose of delivering lead generation and appointment setting services.
  • Personal data will not be shared with third parties except as necessary to fulfill the contracted services or as required by law.
  • All data is handled in accordance with our Privacy Policy and applicable data protection regulations (such as GDPR, where applicable)9.
  1. Payment Terms (For Customers)
  • Service fees, payment schedules, and any applicable charges (such as per-confirmed-appointment fees) will be specified in your individual agreement with Foculus Marketing.
  • Failure to make timely payments may result in suspension or termination of services.
  1. Customer Responsibilities
  • Customers must provide accurate and complete information regarding their target audience, campaign goals, and any restrictions on outreach.
  • Customers are responsible for reviewing and approving leads and appointments as specified in their agreement.
  1. Contact/Lead Rights
  • If you are contacted by Foculus Marketing and wish to opt out of further communications, you may do so at any time using the instructions provided in our messages or by contacting us directly.
  • You have the right to request access to, correction of, or deletion of your personal data held by Foculus Marketing, subject to legal requirements.
  1. Legal Compliance
  • Foculus Marketing adheres to all applicable laws and industry standards governing lead generation and appointment setting, including but not limited to TCPA, CAN-SPAM, GDPR, and state-specific telemarketing regulations.
  • We maintain records of consent and outreach activities as required by law and industry best practices.
  1. Limitation of Liability
  • Foculus Marketing is not liable for any indirect, incidental, or consequential damages arising from the use of our services.
  • Our liability for any claim relating to the services will be limited to the amount paid by the Customer for the specific service in question.
  1. Modifications
  • Foculus Marketing reserves the right to update these Terms at any time. Changes will be posted on our website and become effective upon posting.
